HORSE BOARDING AGREEMENT

THIS HORSE BOARDING AGREEMENT is made and entered into on the (day) of (month), 20__ by and between Gibson Ranch (“Gibson Ranch”) and the person(s) named in the Client and Horse Information portion of this document (“Client”).

SERVICES; DISCLAIMERS; VACATING STALL; EMERGENCY CARE; WORKERS

Services and Disclaimers

So long as Client performs Client’s duties under this Agreement, Gibson Ranch shall provide the facilities and services described in Exhibit A (“Services”) for the horse(s) identified in Schedule A attached to and incorporated in this Agreement (“Horse”) at Gibson Ranch’s stable and riding facilities at 9655 Wentworth Street, Sunland, CA 91040 (“Facility”).

Except for feeding the Horse, Gibson Ranch shall not be responsible for any care, including grooming, exercise, health, or safety. Gibson Ranch is not liable for illness, injury, death, or property damage including tack or trailers. Client is solely responsible for the Horse’s health and insurance coverage.

Vacating the Stall

If Client vacates the stall without 30 days prior written notice, they remain liable for payment for 30 days. If the stall is unoccupied for over 14 days without notice, it is considered vacated.

Emergency Care

If Gibson Ranch cannot reach the Client or Trainer within one hour, they may authorize emergency care or euthanasia if necessary. Gibson Ranch is not liable for outcomes. Client must pay the vet or farrier and indemnify Gibson Ranch.

Workers

Workers may assist Clients only outside their regular work hours. Gibson Ranch is not responsible for this work. Client assumes all liability and must indemnify Gibson Ranch.

DURATION

This Agreement continues until terminated with 30 days written notice or earlier if Gibson Ranch determines danger or injury by the Horse.

PAYMENT: SECURITY DEPOSIT; LATE CHARGES

Payment and Security Deposit

Client must pay monthly fees as per the current Fee Schedule by the 10th of each month. Fees may change with 30 days’ notice.

OWNERSHIP; HORSE’S HEALTH

Client represents that they own the Horse, the Horse is healthy, vaccinated, and has a negative Coggins test if applicable.

LIABILITY RELEASE; INDEMNITY; GRANT OF PUBLICITY RIGHT

Client’s Specific Liability Acknowledgements

  • The Facility has other uncontrolled horses.
  • Horses are inherently dangerous and unpredictable.
  • Equine activities carry unavoidable risks.
  • All visitors assume personal risk.

Client’s Assumption of Risk, Release, and Waiver

  • Client assumes all risk of being at the Facility.
  • Client is responsible for health and safety, and must maintain insurance.

Client’s Indemnification of Gibson Ranch

Client shall indemnify and hold harmless Gibson Ranch from all liabilities arising from the Horse or Client’s presence at the Facility.

Client’s Insurance: Gibson Ranch Additional Insured

Client must maintain $1,000,000 liability and Horse life insurance naming Gibson Ranch as additional insured.

Grant of Publicity Right

Client grants Gibson Ranch rights to use images for promotional purposes with full copyright ownership.

RULES AND REGULATIONS; PROTOCOLS

Client must maintain up-to-date contact information. Changes should be given in writing.

CONSTRUCTIVE RECEIPT

Notices are considered received by personal delivery, courier, email before 5:00 p.m., or by mail depending on timing and location.

MISCELLANEOUS

Successors and Assigns

Agreement binds successors with Gibson Ranch approval.

Severability and/or Modification

If a term is invalid, it will be amended to be enforceable. Remaining terms remain valid. Amendments require written agreement.

Entire Agreement

This Agreement is the final and complete agreement. No outside evidence may alter its terms.
